Can I resign?

Hi,

 

I would like to resign from my job to take a non-paid sabbatical year? I have like 15k to live that year. What happens with child maintenance when you resign and don't get another job?

Hi

CMS is based on income and therefore you will either have to pay £0 or £7 (flat rate) per week if you claim Universal Credit. (not sure if the minimum is always £7 I'm sure someone else will advise. 

Whilst your savings amount is potentially above the amount UC is payable, you should still apply for UC even if they come back and say you are due £0.00 in benefits as this amount will then be used to calculate your CMS.

This is what I was advised when I first started to pay CMS and asked a similar question..

If you tell CMS your jobless , they will ask for evidence. If they happy with it, they should put you on nil rate, where you pay zero maintenance, until you start working again.

@bill337 but you need to make sure you have no arrears otherwise you still owe that money, I was advised that if you loose your job or quite you need to provide a P45 and letter from the employer.

 

They will put you on Nil rate, but if you claim benefits UC you will need to pay £7. however if you loose your job or resign while still owing arrears you need to pay that off.

Hi

The arrears always need to be paid off. However, if you have no job or are on UC then the max you can pay are nil rate or £7 per week. The arrears will just continue to roll until you have an income they do not get written off or anything.. They cannot make you pay any more especially if you have no job..

@patrick1986 yes anytime you tell them you lost your job, they will ask for evidence. I was jobless. they put me on Nil rate. I struggled during lockdowns and ended up signing up to UC. they have kept me on nil rate, and because I have shared care of kids, 1-2 nights week. I don't have arrears. if I do, I doubt they would make me pay if I don't have a job. I have started working again, but still getting UC. there has been no change to my maintenance situation. still nil.
