I split the ex in 2010. I have always used the online CSA calculator and pay her via a so every month without fail. I fall into the basic rate bracket. I am remarried as is she and we share care 50/50. My current wife has raised (rightly so) do I have to continue to pay maintenance?
I have a good relationship with my ex but bringing this up may sour that. Advice to appease my current wife and for me to keep the peace would be crackin Thankyou.
Hi There,
.
If you are working under CSA guidlines then you would still need to make a payment to your ex, you would recieve a 50% reduction as you would have your child for 50% of the time, but you would still need to pay, I'm not 100% certain as to how the CMS work it, out though, CSA will be transfering all older cases accross to CMS who are going to be looking after things.
.
If you have a private agreement with yiur ex, then you wouuld have to agree between you how to change the payment.

Hello Snotrag
If you and your ex-partner have a family-based arrangement in place, you may wish to try to discuss and negotiate your maintenance payments together. Although family-based arrangements are not legally enforceable, parents can decide the terms of their agreement to suit their current circumstances, as there are no strict rules or formulas to follow.
The Child Maintenance Options website has a useful tools and guides section that you and your ex-partner may find helpful when trying to negotiate your family-based arrangement. This can be found at http://www.cmoptions.org.
If you have a case with the Government’s statutory scheme you may wish to contact them directly to discuss any concerns you have regarding your payments. You will find their details on any letters they have sent you or on Gov.uk at https://www.gov.uk/child-maintenance.
The Child Maintenance Service works out child maintenance using the paying parent's gross income, which is income before Income Tax and National Insurance are taken off, but after occupational or personal pension scheme contributions are taken away. In most cases this gross income figure comes from information given to HM Revenue & Customs (HMRC) by the paying parent, their employer or a third-party such as an accountant.
If you have a Consent Order / Minute of Agreement in place, you may wish to see what is stipulated within your agreement as to where you stand regarding your concerns. Alternatively, you may want to seek legal advice.
For more information on all the different ways to set up child maintenance and for a more personalised service, you can visit the Child Maintenance Options website.
The DWP have a sorting out separation web-app that you may find useful. It offers help and support to separating and separated families. The link is: www.dad.info/divorce-and-separation/sorting-out-separation.
