I've been seperated from my ex for over a year.
I have a 5yr old daughter, The ex and myself had an agreement based on my current wages in Sep22 usin g the calculator online and an additional payment to cover the dog which varied per month, and upto Sep this year all was good.
She went through CMS for whatever reasons she felt as it was due for the annual review.
THE CMS are basing the calculation on 2022-2023 P60 data, In between August22 to Apr 23 I was awarded a substantial bonus for business and a backdated salary increase, and I also carried out overtime for Feb, March, April. Of course I never knew the Ex would have filed to CMS many months later, neither did I know CMS use a previous year to calculate.
I can prove the P60 is an overinflated value, but of course my current last two wages don't quite make the difference of 25%. But surely if this is the first time CMS are making a calculation then they can see my true income has been stable since April this year.
I can increase my pension contribution to 50%?
Any advice is appreciated, thankyou
Hi,
CMS use latest available tax year info from HMRC. Unfortunately any bonus, pay rises or overtime result in increased maintenance payments. If your current income has not decreased by 25% they will not make any changes, and will review your income again next year.

Yes, if you aren't quite at the 25% reduction figure, you can increase your pension to get it to that figure. Once it's reviewed, you can always reduce your pension again if you need to, assuming you don't hit 25% the other direction.
