Hi all,

If someone pays CMS payments can a judge order that person to pay for childcare as well? I ask as I was under the impression that CMS payments cover all day to day costs?

I'm not entirely sure if anyone else has been through this. It would be nice to know of any experiences with it.

If you pay child maintenance or even if you don't you are not responsible to pay for childcare. I don't even think a judge could even order you pay for childcare and they also tend not to get involved with child maintenance. if you don't pay child maintenance after CSM is involved they can take you to court eventually for non payment.

CMS has an upper limit that they will order for, after which the courts can be used, I'm not sure what the amount is, but it is pretty large.

Top up is 3k a week gross ..
Above that the court can order additional child payments if the ex goes that route .
I think with all these things the court can order what they decide so nothing is set in stone really
