Hello.....

Hopefully I will get advise from my fellow dads.

I have 20 months old daughter from my wife who left house in March with my daughter. Since then, she used to drop her at my house on every other week for the weekend and taking her back to my wife, and also every month I transfer £300 for daughter into my wife's bank account.

On 3rd of September I was sentenced for common assault and 100 hours of un paid work and restraining order towards my wife only and court told me I have to go through family court to see my daughter and since that order was passed I never saw my daughter and then my wife refused to attend mediation.

Couple of days ago I submitted C100 and C4 in family court and waiting to hear back from them.

I will be representing myself in court. Please any advice what I have to say or do or what the procedure will be and what are the chances that this restraining order will stop me seeing my daughter.

It’s more than likely the courts will take instruction from cafcass in this matter which will be supervised contact it took me a long time to go through court just stay calm and don’t make accusations you can’t back up with evidence it’s not easy especially with the conviction hanging over you just show you have your child’s interest as the upmost importance and show you regret your actions when you speak with cafcass sorry I can’t be anymore help

hi Muhammad,

i have no experience regarding convictions. but from what i have read, it will make things much harder. they will throw all sorts at you, try make you take anger management courses/domestic violence course. they will probably say its not safe for you to see your child and will make you see your child in a contact centre, under supervision, until they see that you have made progress or completed courses, and can then start seeing your child outside a contact centre.

you will need buckets of patience. write up a position statement and take to court with you. take 4 copies, for you, cafcass, your ex and the judge.

As Bill says, the restraining order will not make things easy and you've got quite a long journey ahead.

Try to be patient (I know it's easier said than done) and be prepared for no contact or only supervised to come out f the first few hearings.

I would say that due to the conviction, you would be wise to jump through any hoops set for you in order to see your child.
