Hi,
Does the CSA/CMO (or whatever their new name is) take into account any bonus that you receive from your employer? My bonus is not guaranteed to be paid every year, it depends on company profits.
Not sure about this - it might be worth giving them a call to see how they go about it.
They go off the last years P60, I would *think* if that P60 included a bonus they will still use that figure unless you can prove your next P60 is going to be 25% less
Very unfair
Does seem very unfair - I wonder, if there is a reduction, whether you could ask your employer to withhold more of the bonus to get the 25% change, and then pay it next year (or on leaving).
Even if they held the bonus and paid the following year it would mean the next years maintenance would still be wrong
It wouldn't surprise me if they did it with the P60.
This whole system is a complete joke. My ex gets a serious amount of cash from through a private agreement but I am worried she might involve the CSA. It doesn't surprise me why some people run off and not pay a single penny. My personal feeling is that the max pay per child should be £250-350 per month....but the actual limit is far higher than that. It also bugs me that they really don't care what situation the dads are in.
Thanks for the replies guys. Guess I'll be keeping the ex sweet and hope she doesn't go through the CSA.
Have you gone through the CMS calculator to see what your payment would be if she did use them
When I sent my financial information to CSA they used last 3 months pay statements and as my bonuses are perfromance related did not include those.
Regards,
Dave
Dave that's with the CSA, they are no longer taking cases on
So it would be with the CMS who use last years P60
Sorry my bad.....I am with CMS rather than CSA.
They tried to hook into HMRC with my case but the computer wouldnt do it for them at the time.
Regards,
Dave
Interesting....I am just worried that they would look into the P60 because the bonuses have been paid every year since I have been with the company. So I am keeping my ex sweet by just sticking to our private arrangement, I am far better off that way. I pay her a huge sum as it is but if we were to go through the CMS I would be far worse off, unless I go part-time and pump 25% of my pay into my pension. Also that 20% charge for a payment is a joke...that would cost me probably around £250 alone each month! ridiculous!
They make there calculation based on last 3 months pay slips and calculate an average, so if one month you got a £500 bonus and other 2 months you got no bonus they would just add the £500 onto 3 months total and that would be the amount you pay, but if circumstances change I.e bonuses stop you should tell them and your payments go down
Thanks
