I have been raising my 3 kids by myself for the last 8 years as my ex (although not divorced) wife has mental health issues and lives in a sheltered home. I am now having to sell our home and she is asking for half of the profit which she legally is entitled to. She has not paid me anything to help with the kids over the last 8 year because she has been on benefits. Can I ask her for back dated Maintenance now she will have about £40K in her bank?
Thanks
Hi there
You could ask her, but I don't think there's a legal requirement for her to do so I'm afraid.
Had you made financial settlement on the property as part of divorce proceedings, it would have been likely that you would have been awarded a larger portion of the equity, more like 70/30 or 60/40, ecause you are sole carer for three children.
If she has such a large lump sum I doubt she will be entitled to claim benefits, but without an income I'm not sure if you could claim child maintenance from her....this is something you could ask the Child Maintenance Service about.
The Citizens Advice Bureau might be able to give you advice about your position.
All the best
Thanks for this
