Hi,
I was just looking for any advice possible, as I feel consumed by the lack of help or control I have regards to the CMS.
Their was some arrears accrued some years back, and this was more due to CMS direction, I had informed them I was working etc and they reviewed the case and still said it was a jil payment I chased this up I was promised this is the case and it cant be back dated.
Behold 2 years later, they back dated even though they stated it was nil, anyway regardless this I agreed a sum of £458.38 for the one child.
Then September 2022, my child decided she wanted to come live with me, meaning it was a Arrears only case, CMS didn't beleive me and it took me 2 months to get written evidence that she was now in my care, they changed my case to arrears only, I received a letter November 2022 stating the arrears £2834, but this was on the idea I was still making payment to mother of direct pay and arrears and exact amount of £458.38 was made until December 2022, however for October November and December I paid £355 as agreed with CMS.
Fast forward to June 2023, they sent me a arrears of £4250 with no explanation, I have asked for a breakdown analysis on 4 separate occasion to no outcome or evidence.
Now my child has gone to live back woth her mother, they have now gone from direct pay to detachment of earnings, there reason was they said there was a missed payment, again no mention of which payment or warning, however they said they sent a text message.
Now my employer has received 3 separate detachment of earning 1 for £200 another for £135 and third for £814.
While also requesting a direct payment of £349.50 which also includes some arrears, I have telephoned several time been put through to a case handler, they have said my case is a absolute mess and don't know what's going on and needs a full review, promised a call back etc, but haven't had one, I have chased 4 times now and promised callbacks everything that haven't happened.
I spoke to someone at the cms today who stated, "there working on it, and if the payments are wrong we'll refund them" I am pretty sure that will not happen, but essentially the total value there requesting monthly is around £1500 a month, which is more than 45% my monthly salary before tax, which I am pretty sure is illegal?
I also have another child who I ammicably pay towards.
I have also written to my MP and they have sent a email to the DWP, but right now it's more of a case, of the payments will not be sustainable for long.
Any help appreciated
Mark
Hi,
Sorry to hear this. It's horrendous when they get things so wrong. It's good that you have contacted your MP. Suggest you keep in their case and ask MP to make formal complaint on your behalf.
