[Solved] Arrears

Hello to one and all....it's my very first time on this website so please bear with me. I have an 18 year old son but myself and the mother split up when he was less than 1 year old (we we're both young long story). Now I contacted the CSA in the late 90s the get child support paid to the mother. A few years ago when I changed jobs arrears accrued on the case which I paid through a deductions from earnings order (this is how I pay my maintenance anyway).

I contacted the CSA last week to inform them I have very recently changed jobs again and would like to set up a deductions from earnings for my new employer.

I was told yesterday that my new payment would be x amount but I was also told that there was over 1000 pounds in arrears on the case which I was never aware of and the CSA have never notified me of.

Each year I get a payment schedule showing my payments for the year and a few years ago when there was arrears on the case it also showed the amount of arrears that would be deducted each month.

For the last 3 years minimum there have been no arrears and the CSA have not made me aware of any arrears until yesterday when they dropped this bombshell on me as I pay directly from my earnings each month.

Which way do I go about this as I don't have a clue so any help/advice would be greatly appreciated.

The CSA are a law unto themselves and their are many reasons for it including your case moves around the country without you knowing and therefore continuity is nil and its difficult then to prove your case. The CSA don't even follow their own rules as I had an arrears issue for just £350 so when we discussed it and I then enlightened them that I had 50/50 care and infact I had been paying too much for the last 2 years approx. £3000 and I had the evidence to prove it they said If I don't appeal the 3k they will let the £350 go. They told me it was my responsibility to tell them of changes but they wont accept my notification if its not supported by the mother. When I quoted their rules that clearly states its the claimants (the mother in this case) responsibility to notify as per section in their handbook they choose to ignore it and make their own on the spot rules.

I just can't understand where the arrears they claim have come from as I did have arrears on my case a few years ago but I paid those off. Now I have changed employer and made them aware suddenl8they say I have arrears of I erm 1000 pounds....I just don't understand it really as I have always paid through a deductions from earnings order....

Do the CSA have to make me aware of any arrears on my case.....as I am [censored] sure if I had arrears on my mortgage then my mortgage provider would certainly contact me to make me aware

Hi all I'm new on here. Was going to create my own thread but seems folk on this one have similar issues. My arrangement with CSa ended in august and transferred to the child maintenance services. I rang the CSa to ask why they had not cancelled there direct debit and a very snotty woman said they will cancel it and my account is £313 in arrears. A breakdown came through the post which was very confusing. It says a payment by me was cancelled one month 7 year back which is impossible as I had not cancelled the direct debit and doubt my bank will have made error. Anyhow if they did why did the CSa not get in touch in 2009. Where rest of arrears come from is a mystery as I have always paid on time and the amounts they said. If they have made a error how is it me to blame. I went to citizens advice who were useless and the child maintenance service who seem a bit more helpful said it's nothing to do with them. I contacted bank tonight and direct debit still ain't been cancelled so I cancelled it. If they took the payment next month I would effectively be paying double. Any advice appreciated, cheers

Hi

I would ask the CSA exactly when the payment was cancelled - the annoying thing is that banks only keep records for 7 years I believe so verifying this may be difficult, but I'd certainly see what the CSA come up with. It's entirely possibly that the CSA have done something wrong, but it's then down to whether it's just them failing to notifuy you of money you owe, in which case yo do still owe it, or whether they have made a mistake in their calculation.

Thanks for reply. Apparantly i still owe money. They sent a statement out which is very puzzling even shows 6 payments (credits) been made one month which never happened. Im tempted to just pay the arrears so i never have to deal with this horrid organisation ever again. They seem to think of there computer says you owe x anount they are right
