[Solved] Arrears

Hi everyone,

First timer on this forum.

I've received a message from my daughters mother that she's received a letter detailing a 'mandatory review' and that my payments would be £430 pcm. Firstly, I received nothing from the CMS about this which has worried me as I don't understand why they'd send her a letter and not me. Yes it might have got 'lost' in the post but that isn't my fault.

Anyway, I've then logged into the CMS account and it shows that now I have arrears of over 1.2k!! Thing is, I've always paid, on time and in full. I resigned from a job last December and made the CMS aware of this to which they 'managed' to send me letters explaining that I would pay 'nil' rate due to unemployment. I'm never the type to just be unemployed so I bagged a better job in February. I made the CMS aware of this change in March (totally forgot to immediately advise) but I was faced with multiple projectiles from the terrible call handler such as how long was I at X company, when did I start at X company and other unnecessary questions that really wasn't relevant to what my call was about. (The questions were about the last firm I resigned from and not the current role I'm in presently).

I answered these as best I could until I became somewhat frustrated that my call just wasn't being dealt with for what I contacted them about. The call handler then chose to hang up and that was the end of it. I was extremely angry at this point as I've been on hold for over an hour and I receive a service like that. I chose to leave it until they sent me a letter asking me to confirm anything. They did not.

So, my question is, why would I now have arrears when I am fully upto date? I've never failed any payments nor have I ever been late. I've been met with this mistake more than once with the CMS and they did rectify this however, in the current situation we're all facing with this 'human virus' I've sent them a message only to read that it'll be read within 12 weeks! That's not to say it'll take 12 weeks but come on guys, most of know what this organisation is like!

The payment schedule has since been increased (earning more) and I'm more than happy to pay the extra 80 odd each month but to whack on 1.2k worth of arrears is just unacceptable, unjust and given that there is no explanation anywhere about this, I am downright confused, stressed and upset. I just cannot see how I am now required to pay this extra when I know full well I won't get it back.

If anyone can provide any advice I'd appreciate it with open arms. The local MP Mr Stephen McPartland I've contacted numerous times about the conduct of the CMS but to no avail.

hi,

when they review your income, your also entitled to a mandatory reconsideration. don't know why they didnt bother write to you. what i found is that i make a lot more progress dealing with CMS, when i just sign into my account & send them lot of messages and documents. you could do that, detailing your recent employments, wage slips/p45 and ask them to investigate why your arrears are so high. if you still get nowhere, then you can ring them and ask to go through their complaints procedure.

even though they mentioned getting back to you in 12 weeks, they been getting back to me in 1 or 2 days.

Did you have an old CSA case? Wonder if a debt has been bought over from there.

A Mandatory review has to be triggered by you. You would send them details that your income has dropped by 25% or more, so I am surprised that you have not done this but your ex has received a letter.

Are you sure you don’t mean annual review? What correspondence is on the portal?
