Hello,
I received payments as part of the Armed Forces Compensation Scheme due to service incurred injury. The injury is chronic, freezing cold injuries. I have received lump sum payments under the armed forces compensation scheme.
I do not draw a war pension as I was not medically discharged, I chose to leave/was pushed out by end of tether CO who gave no fucks about unseen injury while he had lads with missing limbs next to me. Being young 22 after being in for 5 years & being permanently med catted while forced with the prospect of being p7p, p3 base dweller or gtfo'ng, Looking back I should have just drew a fighting man salary while being base bound in the UK till they got bored of me, but at the time I was too proud alongside having places to be so I joined another outfit in the M.E.
I still have a chronic injury due to service which has effected my salary a lot more than the rewards I got. I work full time but I can only manage indoor work as I lose control of my hands in cold weather. Do I qualify for flat rate CSA payment plan? I have provided CSA with my reward statement. I am awaiting their response for payment, it's been a month and they have not given payment plan but I'm just hoping some expert here could link me to the writing regarding CSA flat rate entitlement & AFCS payments. I should probably go for another review but I lost all medical support upon leaving. I know it was probably dodge to PPR as p7 but hey up, I can walk & talk.
Also if I am rewarded discount will the mother receive anything to compensate from the state? If I am rewarded flat rate I'd like to make voluntary over payment unless it detracts from any potential increased benefit the mother would get. How would any over payment effect say any later arrears if I was to be made redundant? I have full contact with the kid and do not have any contact order or desire one as me and the X are on good terms with custody. It's only budgeting we ever argued about, she blew through any cash she had on frivolous luxury, holidaying ect.
Regards,
Here’s a link to some more info about how the CMS calculate maintenance. There’s a section about what benefits are eligible for the flat rate... it does mention the Armed Forces Compensation Scheme.
The mother can claim benefits if she is entitled to them, but there’s no compensation, if child maintenance is reduced. Overpayments are discretionary and shouldn’t effect any future finances and child support payments don’t effect any benefits she might be on.
I have received armed forces compensation via afcps so I guess its as simple as that, does not really matter if I got lump sums or if I receive a weekly pension in my mind, my injury is not going to magically heal even if the MOD does not pay me a pension but instead paid it upfront.
I'll post the CSA decision in case anyone else that has gotten afcp's payment before and is in same boat.
Thanks,
Thanks... let’s hope you get the right result.
