[Solved] Annual Review

My 1st annual review is today (27th May). My payments are unchanged!

I used to pay on the basis of the CMS calculator until she got the [censored] when my income went down quite a bit and she got the CMS involved (payments the same as I was paying)

I am self employed and my accountant filed my tax return on the 12th May and my income has gone down by about £2000. I also sent the CMS a letter asking for 3 trips to see my kids instead of 2 (I used to do 3 and she used to do 1). Also in the letter was my pension contributions (started 8 months ago). I also sent them a copy of the court order I got about 4 months ago. They received this around the 12 May.

I have looked on the CMS website and then use the figures from 30 days before and are supposed to send me a letter 20 days before the effective date (I havent received this) but it goes on about the 25% change rule

I know they will take the travelling costs into account, but will they take my pension contributions into account, what about the drop in income.

It seems crazy to have an annual review and yet its based on income from a month before.As I am self employed I only get an annual income and file once a year.

Things are tough as the moment work wise and I could do without paying too much child maintenance

hi,

they should correct your maintenance payments if they did annual review based on wrong or old information. i been self employed until recently. when they did my annual review, they just see my salary info with HMRC. then i ring them up and tell them I have extra income from dividends.

with the drop/increase in income, they only apply the 25% rule if the income change happens in the same year. i stopped being self-employed end of march. got a perm job and lost it after a short time. my income dropped by 25% so they reduced my maintenance.they should adjust your payments if your court order mentions shared care and number of nights you have kids.

The number of nights havent changed since the court order just when I have them. Before the court order I had my kids every wednesday, every friday and every other saturday. I now get every wednesday night and then every other weekend friday after school to monday at school. The only thing my ex was consistant with was that she didnt want me to have more nights, I suspect it is because she didnt want CMS to go down.

I have asked the CMS online to take all 3 items into account and it says they will get back to me within 12 weeks. I know things might be delayed with the corona virus but 12 weeks, [censored] [censored]! I hope I dont accidentally enter the incorrect details online and get logged out. I could then can call them and hopfully they will sort everything.

hi,

that 12 weeks to reply is just an advisory. I have been messaging them online, and they get back to me in 1-2 days. as long as you sent them the court order, they will work out the shared care/number of nights. if your 2019/20 tax return is ready, tell them to assess your income on that if you haven't done so.
