No they do not.
CMS do not take into account your living expenses such as rent, bills, council tax etc.

Hello john 991

If you are the paying parent, the amount of maintenance you pay is worked out based on your gross income. Any outgoings you have are not usually taken into account.

If you are the receiving parent, any maintenance you receive may be taken into account when calculating the amount of Council Tax benefit you are entitled to. You would have to contact your local authority to confirm that.

You can view detailed information about how the Child Maintenance Service calculate maintenance payments and what they take into account here, https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/325219/how-we-work-out-child-maintenance.pdf

The Department for Work and Pensions (DWP) have a web application, ‘Sorting out separation’. It aims to make it much easier for separating and separated parents (and childless couples) to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues. The link is http://www.dad.info/divorce-and-separation/sorting-out-separation

There are various different ways to set up maintenance payments. If you would like information on this and a more personalised service, you can contact Child Maintenance Options directly, http://www.cmoptions.org

Regards

William
