Dear all,

up until now I have paid the precise amount suggested by the CSA in respect of my 3 kids, £351.10!!! Since our separation, the kids Mum has made her own choices and now has childcare costs of £900 per month to deal with, crucially when she has them in her care. I didn't have any say in her decisions regarding childcare.

I have now been summoned to the sheriff court, she is asking for aliment of £450 per month to cover half of the childcare costs. (It's a privately run out of school care club).

If I am told to pay this extra money, I will have to sell my home and move back in with my parents. I can't make ends meet as it is, (my own mortgage of around £380, travel costs of £350 approx per month, expenses when I have the kids in my care, a flat that I rent out, the tenant is about to leave and so I will have expenses to pay for that of over £300 per month until I get a new tenant or sell it.

Will I be expected to pay this extra £450 per month?

When we separated, I walked away from our marital home, a home that I paid for entirely, so that the kids would not need to move out.

I would probably say that this is a luxury for your children And not would would not be liable for the extra cost, simply because your children do not need it.

If you do end up paying its extreamly harsh.. Which probably means you will they way this system is run

Hi

To the best of my knowledge, you do not have to pay more than the amount set out by the CSA. I assume that you are in Scotland, but as far as I am aware, the rules are the same there with regards to maintenance - it might be worth having a word with the Scottish Child Law Centre www.sclc.org.uk to see if they have any knowledge of this area.
