Okay, so i was put on direct payment after delaying payment for 3 days as I was on holiday(she was aware).

 

I believe anger got the best of her as I was on a holiday she had dreamed of for years for us.  She put me on CMS via my employer straight away.

After months, I finally made her understand that CMS is taking 300 quid cut just for their services and this should be benefiting the kids instead(300 is some people's total payment). Finally she cancelled it and i sent her money to her account directly as before, and my employer paid CMS for this month as CMS said they should continue and allow allow CMS(dwp) 12 week window to process the case cancellation.

 

I sent her proof of the money paid by my company and she has refused to send me back the money i directly paid her. What do i do? scared if i just withhold payment next month, she will contact CMS to open a case again.

you could tell CMS you overpaid. but if she disputes, they may say you voluntarily paid her extra money and nothing they can do. they is option to apply to small clams court, but will likely create more conflict with her. perhaps better to let it slide?
