Paid an agreed lump sum to the mother as she wanted no further contact. Paid via bank transfer with reference child maintenance. 3 months later makes a claim Csa say any money paid before date of claim is irrelevant. Anyone had any similar situation that can give me some advise
Thanks
Was the agreement to pay the lump sum an informal agreement between yourselves, or was it via a court order?
She could argue that what you paid previously was in fact child maintenance that you had agreed upon, she has the option of opening a case with the CMS....she may have you over a barrel here, but I'm not an expert, hopefully someone who knows more will be able to advise you.
I'm afraid the CSA can come after you and disregard anything beforehand, unless it's a court order, in which case they can only disregard it once 12 months have passed.
