[Solved] Advice pls

Hi there

I currently pay CSA, always paid and always paid on time etc. My ex recently made an appeal and took me to court as she thought I was lying and hiding money which I wasn't and it was proved in court that I was being honest and she basically got made to look like a pratt. She basically has issues with me leaving her . She is now living very comfortable with her new partner in a 6 bedroom house (which I believe I have contributed to over the years and when we divorced and she received a large settlement)

I have been struggling financially with my new wife and family for the past few years. I have now found out that I am apparently supposed to be receiving a bonus in my salary before Xmas - should I inform the CSA of this, as she is likely to receive some of this and I am reluctant to share this with her seeing as my son never sees any of the money. If anything I would rather put some money by in an account for my son.

The CSA have not asked me for any payslips recently and I do not have an arrangement with them where I have to keep sending them.

Advice please would be grateful

CMS worked out my calculation based on basic salary and not any perfromance related bonuses as they were not assured.

Id put it in an account and buy your son something nice.

Others may have differing advice so you may wish to get more opinions.

Agreed, csa takes it from your basic salary.

My advice, don't say anything and put it to one side, Especially if she's 'comfortable'

...I agree too! Treat your new wife and family and son and forget about the CSA and your ex....enjoy!

Guys, is this correct?

I'm in sales and I am paid a basic plus commission but commission is not a given and I'm sure that I have been paying too much as they calculated my payments on my basic and average commission.

They rung my employer and to work out how much I am on and I'm paying more than my basic alone!

Please can someone reply ASAP as I have been paid too much for too long!

Hi I am Lloyd,

The calculation is based on basic salary is my understanding but may also include other regular payments which is possible why they have averaged out your commision.

The additional income that was seen in my case is performance related and not regular.

Did they use your OTE as you would be expected to reach your targets?

Might be worth taking up with them again but unsure what response you may get if your commision is regular and you have targets.

I think this is correct - if you are receiving regular commission or overtime, then it is included. With a one off payment, it's probably not fair to base it on this as it's not an income you can rely on. You could always put the bonus into your pension - that way it is excluded even if the CSA ask, as long as you weren't putting it in there to avoid paying maintenance on it.
