Hi Guys 
I am based In Scotland
I’m looking for some advice if possible? I split from my wife in Jan 2021, when we split I was really struggling with my mental health and she basically dictated when I would have him and unfortunately I was not strong enough to say no and day my own terms, after the split I was already paying money monthly an amount which I felt was adequate for what I done for Douglas this was all going well until she went behind my back to CMS for me to receive the letter on a special day for my son which really hurt.
I have an 8 year old, I pick him up on Monday evenings take him to Football and I also have him 3 outta 4 weekends from Friday 3pm until Sunday 6pm.
I’ve always been a hands on dad and will drop anything in a heart beat for my boy.
My ex wife works on a Monday, Thursday and Friday 2 and a half days. She will see Douglas and care for him eg get him up for school on both Tuesday and Wednesday, his gran will care for him the rest of the days.
She is marked as resident parent and I have been fighting with CMS to show them that I am there for if not equal but more care I’ve got 2 years of evidence written down of extra care days and also sent all documentation from voice of the child and more! But still they push back..
I’ve mentioned to the ex that I’m always there for my son and that I deserve for it to be 50/50 but she will always just blank my question?
Where do I stand what is my next step?
I am only looking for 3.5 days a week and I’ve currently got 2.5?
As I farther I feel it’s my responsibility to take my child to and from school as well!
Any help would be appreciated and also sorry to hear everything is also having trouble!

hi,

CMS prefer to see court orders to decide who primary carer is or if there is 50/50.

so you may have to consider seeking one. different process in Scotland. theres a very useful guide here:
