Advice complex case

Hello I have a fairly complex case I have - 12 year old daughter who has cerebal palsy through medical negligence And won a case against nhs due to her injuries 

a bungalow was bought and Adapted for her out of her award and all bills are paid for out of her award also 

she lives here with mum , mum has no costs to put roof over child’s head 

Also excursions some clothes and food are also bought for her out of her fund

she comes to be over 104 nights per year and for tea other nights

i am currently waiting a tribunal hearing 

as I believe there are exceptions in this and there is no /minimal financial benefit to our daughter from the child maintenance payments 

due you think tribunal willlook at the case in a individual basis and reduce payments due to daughter owning and paying all bills, mum doesn’t have any costs to put roof over child’s head

Not sure about this. I read you can claim expense if your paying parent, if you support another child that has a disability. I recommend you join this support group for paying parents:

The tribunals certainly used to be able to look at cases on an individual basis, but there were only certain circumstances where you were able to go to a tribunal. One thing to be aware of is that child maintenance will continue after age 20 if the child is disabled and cannot live alone, so this is very long term planning.

@actd Sorry to hijack the post. But can you clarify by what you mean by 'child maintenance will continue after age 20 if the child is disabled and cannot live alone'. 

I understood the Child Maintenance via CMS stopped at 20, regardless of any other circumstances. My child has some development delays, however I have been assuming CM finishes when she turns 20. I do intend to continue paying something each month, but at my discretion, I did not have in mind at someone else's direction.

Appreciate if you can advise what is behind this and who controls the decision.

There are no costs associated for our daughter in aspect of putting roof over child’s head/shelter/bills as she bought and pays for all this though her negligence case and her award?

do you think a tribunal will take this in to account ??
