my son lives with my ex and they in turn live with her mum and dad (not ideal i know) my daughter and ex have been kicked out and now live in temporary accommodation (a hotel) my ex didnt want my son staying there so he now stays with me and has done for the past 6 weeks , i dont know when they will house her , do i still have to pay maintenance ? only reason i ask not long bought a new house and money is getting tight and with an extra person under the roof and also paying maintenance
hi,
you could follow the guidelines that CMS use, that if this change in care is expected to last at least 12 weeks, then you could suspend payments. but problem is your ex can open a case with CMS any time. if she is dishonest, then very likely (if no court order) they would take her word for it and expect you to carry on paying, although child is staying with you.
