Hi all

Just looking for a bit of advice about the current situation I'm in . I have a daughter aged 17 in further education. I currently pay child support to her mother & have some since my daughter was 5. Recently my daughter & her mother had a big bust up , they often clash alot & as a result she Is now living with me & has been for the past 3 weeks & it looks like for the near future too as her mother hasn't been in touch & vice versa. My question is how does this affect my child support payments? I understand I'm still obliged to pay it , but I would rather give the money direct to my daughter each month until she finishes further education. Surely if my daughter is no longer living with her mum , I dont have to pay her ?

Any advice would be great thanks

Hi there

Have you called the CSA/CMS to tell them about the changes?

If the mother is still claiming child benefit, you may have a problem getting the CSA/CMS to accept it. It might be a good idea to start a claim for child benefit and then you can claim maintenance too.... although there’s nothing wrong with you opening a claim for both at the same time.

Hi

Thanks for the swift response I haven't yet contacted them as I dont pay direct through them , I have an agreement with my daughters mum which I was told to continue by the CSA when it ceased to existing a couple of years ago.

You could give the new(ish) CMS a call and open a claim yourself.

My daughters mother & her partner are unemployed they both have been since I can remember. Can I still open a claim ? Think in either event I need to speak to them & tell them the change in circumstances

My input for what it is worth.....

Before any conversations are had about stopping maintanence, get the child benefit changed to your name. This will be hugely beneficial to you. After you have done this you can raise a CMS case against the mother if you so wish. If she is on benefits you will get £7 per week.

If you don't change the child benefit first, then this may happen.....

- You talk to mother about stopping maintenance as she is living with you.
- Mother gets irate at this and says you stil have to pay, and raises a CMS case against you
- The CMS will more than likely rule in her favour as she stil has child benefit, and you will be liable to pay. The CMS are heavily geared towards mothers, so if she tells the CMS that her daughter lives with her not you, they will most likely believe her,
