Hello all. I currently pay maintenance for my son who is in education and 18 years old.
This could be his final year and what i'd like to know is how can i find out his education status? i have no contact with him or my Ex.
The only answer i can find is to contact CMS nearer the time of his possible education ending.
any advice or pointers much appreciated
It's very difficult when there's zero communication between you.
Generally the CMS will look to see if she is still claiming child benefit, as they use this as an indication that she is still eligible for maintenance. If a child remains in non advanced, full time education, or an approved apprenticeship, your requirement to pay can continue until your son is 20.
If you know the school/college he is attending you could try contacting them. Unfortunately the Child Benefit office won't share information about your ex's claim for child benefit with you, but if you suspect she is claiming when she shouldn't be, you can ask them to look into it, or you can write to her and tell her that she must contact the Benefit office and tell them he is no longer in education, otherwise you will have to report it as fraud.
