Breach of underwriting promise to the courts

My ex was given a underwriting promise to the courts and I am after some advice as I am unsure???

Since the undertaking was issued my ex continues to submit court application with false allegations that damages my character; since the proceedings they have submitted court applications of fraud, and C1A with false allegations and false information on a CAFCASS report.  All have been proven through my solicitor and they mentioned that this could be breach of harassment due to the false allegations which are continuously occurring since the underwriting promise was issued.

on the undertaking it states not to harass or pester etc....the question I have ??

Is this classed as a breach of undertaking due to the continuous false allegations and information they are stating about my character as I feel the submission of court applications are not going to stop.  At the moment my ex has submitted 5 court applications to court with all false allegations and false information some of the hearings have proven to be false and still nothing has been done by the court due to false allegations submitted can I submit a breach of the undertaking to stop the court applications with false allegations and information?

Hi,

Am surprised your solicitor has not mentioned a barring order? Can apply to ask court to ban ex from making further applications. Can be done with a C2 form.
