Whats the law on Child Maintenance after redundancies

I ordered my ex-partner to pay the full Child maintenance for the notice period of 3 months after my redundancy (which I'm unclear I had to) and explained after that period it would stop until I get a new job. Of course, the money-minded person she claims I have to continue paying regardless, even if it means my house is at risk. Can anyone advise me of my rights? Do I have to continue paying even though I have no income?

Hi,

are you currently in a private arrangement to pay maintenance to your ex?

if your going through CMS, then they will not expect you to pay if your jobless, as payments are based off your earnings.

@dadmod2 It was arranged through the financial constent, not CMS. Where do I stand then?

@rel2009 financial consent order? these are typically valid for 12 months. then after that, either parent can go to CMS. if you check it, see if there is any mention about 12 month period.

From what I have read, the Redundancy payout is not classed as income, and even with a court order, I'm not sure I have to pay any child maintenance moving forward.
