Shared care and maintenance

Hi there.
My son is dad to a 3 year old and is in the process of increasing his contact to 216 nights per year as part of a shared parenting arrangement with a mediator. Can you advise whether he will still be required to pay maintenance or whether (as co parents), there is no liability for either party.

Hi,

if the agreement will state there is equal day-to-day care of children between both parents, then there should be no child maintenance to pay.

Child maintenance services uses these overnight shared care bands:

The amount of child maintenance is reduced for each child who spends time with the paying parent.

If over the year your child is with the paying parent between:

  • 52 and 103 nights: child maintenance is reduced by 1/7th for each child
  • 104 and 155 nights: child maintenance is reduced by 2/7th for each child
  • 156 and 174 nights: child maintenance is reduced by 3/7th for each child
  • 175 nights or more nights: child maintenance is reduced by 50%, plus an extra £7 a week reduction for each child.
