[Solved] representing myself in court

Hi all, im representing myself in court, for the first two hearings i think .. and getting a barrister for the 3rd .
can anyone explain what i can expect.?

my ex has been restricting me access, and sporadically been seeing my kids.. my ex has said i can have them for 3 nights a week if they want to come they are 2,5,6 years old.. seeing my kids only 7 nights in nearly 40 nights. ive always been a hands on dad working around the kids so full time dad and apon our split being a 50/50 until she decided to change this in december.. i have filed for court so awaiting my court date...
as im wanting joint ccustodial parenting both primry care. and 50/50 with the kids..

just like to no what to expect , getting all evednce together... i have a paper trail of texts to show all

hi,

for all the hearings you should prepare a position statement (2 pages max ideally), and email it to court in advance if it will be a remote hearing. If in person print and take about 4 copies.

1st hearing will be short, and court would like to know what the issues are. Cafcass (social worker) will very likely be involved. If your ex makes any allegations and cafcass thinks there are safety issues around kids, then they will likely order a section 7 report to be done. that takes around 3 months, and should be completed in time for your 2nd hearing. They will interview you. The Cafcass recommendations will be crucial about what arrangements will be set out for the kids. The key is to remain calm and stay child-focused.

I was expecting my 2nd hearing to move onto a 3rd and was ready to hire a barrister. But judge didn't see major issues, so converted 2nd hearing into final.

a position statement gives brief background to court about why you are there, and what you would like court to do to resolve the issues with your situation. In it you should write what kind of children's arrangements you are seeking, e.g. 50/50 or have kids every other weekend, school holidays etc.

i had my kids three nights last week, she has said i can have them three this week, however if they want to stay with her she wont bring them... im at her mercy for now. she also started with 2 nights only offer now its moved to three..
i have all on text. she said " she finds it hard giving them to me for three nights , and if theres any probs she will reduce me seeing them... all i want is to jointly bring my kids up .... she is fishing in a pound with no fish... so when i go to court ... i cant see what she will say to stop the kids from being jointly with there father..

If shes offering you 3 nights a week i would take it and if you already going to family court you could get it written out as a final order. It would be lives with mum spends time with father. You could end up less if things turn hostile between yourselves.

she is hostile and has kept the children.. facts dont lie.. i am going to court to get 50/50.....
its all about money and her not having to work.... nothing to do with the children... terrible human

I would take everything she offers you as that will look good for you when it goes to family court. A lot of mums give ZERO contact and make dads go through the daunting process. You may not need a barrister yet as it will largely depend on how your court case goes and what contact gets recommended in s7 report.

thanks why dows it look good if i get the kids in family court? she has part said i am only allowed them 3 nights now.. and she now nows shes going to court as ive just got the court start date for the 30th march. she has said in a text she refuses any more access..
