Does anyone know what happens if you apply for declaration of parentage without a birth certificate. Need to get proof child is actually the parents, before applying for contact order? Not on birth certificate, don't have a copy and can't get hold of one.

hi,

is your ex saying that your not the parent? if your paying maintenance through CMS and there's dispute about parentage, they can ask you to take a DNA test.

They have said it in the past that they are not mine and she never put me on the birth certificate, the child is now nearly 10, he lives with his nan who has denied me contact, I am not currently paying CMS and have been putting this away in another bank, I just want to get a DNA done through court, so I can get the peace of mind child is mine and move forward with contact order. Any idea?

I think you should apply for the c100 child arrangements order first. can take 2-3 months to get a hearing. if theres issue about parentage, court can decide what action to take.

there is also form C63, for applying for declaration of parentage:

I want to confirm they are my child before I seek contact, I thought it was the C63 form I needed but it says attach birth certificate of child and I can't get access to that?

in the section about why you are making application, or additional information, you could write that you do not have childs birth certificate, and ex not willing to provide it.

Thank you, it says in order to get declaration of parentage you need sufficient evidence for the court to consider, what evidence could that be, do you know?

C63 form costs £365:

For evidence you can simply right you were in relationship with ms xxxxx. Had a child. State childs name and date of birth.

You could also talk to a solicitor if your unsure of anything. Many offer a free consultation.
