Yes she was in receipt of legal aid before the non molestion order was put through.
I reported it to the fraud team as I know she has more than £8000 in savings and asset.
So it could of been they have stopped it and investigating it and she is trying other means of funding it.
I think everyone should as the ex solicitor if they are in receipt of legal aid and provide the certificate you can take it from there
I have been asked by the court to the following by 6th July for the 2nd hearing
1. option to provide witness statement from someone else
2. provide my own witness statement
3. provide a response to the applicants allegations - the Ex has not provided this
4. provide the judge 5 questions to ask the applicant
As I have responded to her allegations from her original statement, do I just keep that as it is, as she was told by the court to provide 5 Allegations against me out of the 25 she provided to court by the 22 june and she has failed to do this.
Is there any point putting in a witness statement from myself, I feel I might be giving her ammo for no reason when it is her case to prove and judge had refused this at the first hearing.
Also judge asked me to provide 5 questions directly to her which they will ask the applicant, is it worth doing this?and is there specific questions that can catch them out which can also favour me for the CAO to prove she is a liar.
I know everyone case is different but there must be one common question that can catch out someone providing false allegations
The hearing shouldn't be about proving your ex a liar but about getting a fantastic contact order. All you should be doing with her allegations is saying politely they never happened and aren't factual thank you. non molestation application and endless allegations is been done out of spite to prevent you having a relationship with your child.
I assume a witness statement would be a short statement to courts refuting all allegations and saying they aren't factual and a brief write up how important it is a child has a loving relationship with both parents etc.
your ex sounds like she has a solicitor that is going to be awkward and play games whereas yours seems child focused. also at next hearing you want to be looking at trying to increase contact
