Hello,
I have final hearing coming soon. The case is from mother about relocation of child to another country. Cafcass s7 stated that child wishes to stay in the same country he is and he is happy to stay with me if his mother wishes to go. I need guidance on Child Maintenance. I need to request from the court that mother needs to pay child maintenance if she wishes to move as she is more financially stable. Can someone please guide me the process to request that?
Is there any form to fill that needs to be submitted with my Final hearing statement? Or I can add that request in my final statement?
Also is it going to reflect badly on my case? Should I leave it for now and once the judge finalise the decision then I can request him in the court?
Please let me know. Thank you
hi,
family court will have no control over child maintenance, especially for another country.
if child lives in UK with you, then you can open a child maintenance case with CMS. then if she moves to other country, you can enforce the maintenance. this only works if that country has maintenance agreement with UK/CMS. please see REMO countries:
