[Solved] Covid-19 Key worker

Hi,

Can my Ex refuse to allow my daughter to attend nursery during Covid-19 outbreak? Being classed as a Key worker the nursery will still accept my daughter for the one day a week she attends.

Given the current climate and the directions from Andrew Macfarlane re: child arrangements orders, I would imagine that she would have a case that she is putting the child as priority particulary if she is able to stay at home to care for them. If you child will be in nursery whilst you are at work, would it not work if your ex kept your child whilst you work and then you can collect them at the same time you would from nursery when you would have finished work.

The key here is try to work with the ex, you may have to give some ground to ensure your ex continues to make your child available for contact. Otherwise, it's unfortunate but the ex's have got an easy excuse at present to be obstructive.

Currently, she is working from home and im able to be off on the one day our daughter attends, but the ex feels our daughter is better placed to be with her as the nursery is shut even though I've confirmed I have the time off where she is still working all be it at home. she's also now changed her position saying she is not working but I feel this isn't true.

the if our daughter can still go to nursery - isn't important that young children attend? and then get rid of any issues with who should have our daughter on the said day.

she is already spending extra time with our daughter on days normally her mother would care while she works. so to me it made perfect sense that I since being able to have the time off the Thursdays days should be mine. our daughter already wakes with me on the day she would be due to attend ( 2 years old)

hi,

yes a lot of mothers are capitalizing on this crisis sadly. if they wont allow you to see kids, then they have to atleast allow phone/video calls. i waited over 3 weeks to get video calls. dealing with nonsense.

is this looked upon badly in the eyes of the courts? whats to say I cannot do this? im feeling the general rule is mothers can do what they like and best we can ever hope is 50/50 (if lucky and there hasn't been many false allegations). I really do not understand why the law is so sided to the maternal side.

yep, when court order says kids live with mother, that gives mother a power trip. in those cases when mother is so nasty that they just block the dad from seeing kids for months on end or keep on breaking court orders, that's usually when courts start becoming harsh on the mother.
