Hi Dads,
If my Ex applies to CMS, will they contact me for further information about pensions etc and give me an opportunity to reply with more information, or just make an award to the Ex. Im asking because if CMS are missing information on pensions they may make an award, and then not correct it later, because it does not meet the 25% difference in income rule (ie they perceive the difference between the actual amount CMS awarded and the correct pension/ income figure is too small to make an adjustment even though the dad will then be overpaying for a full year until the next Annual Review). This is so grossly unfair to assume that a 25% difference is too small to make a correction, especially if the CMS have made the mistake!!!.
Is there opportunity for an appeal if the income and pension figures are wrong, even if they are below 25% different to the CMS award? Do you have 31 days etc?
Please also clarify if the Annual Review makes adjsutments for these kind of mistakes

Not that I am aware of, but you could increase your pension payments to take you over the 25% threshold and notify them, then once they've recalculated, drop you pension payments back down again and as long as that change is less than 25%, you're ok until the next review.
